To make the reservation of an accommodation subject to the following general conditions which govern the temporary accommodation contract between Usted (Client) and the Property, with the intermediation of Tu Casa Gestión Inmobiliaria 2023 S.L., in conjunction with the agency.

Our personal data will be accepted in the manner that corresponds to the data protection law, and in any case it will be subject to third parties for any type of commercial or other natural action.
Prices
The prices provided as a result of your search are for the period consulted.
Prices include: Final cleaning, water, electricity and gas consumption (unless otherwise specified on certain dates), bed linen (sheets and shower towels), garden and pool maintenance (if applicable).
The price of the stay does not include any type of travel, theft, accident or civil liability insurance resulting from the client's action against other people or things, so the agency is not responsible for any eventuality that may happen to you. to the client in the situations described inside or outside the rented home.

Reservation conditions
Once the reservation form has been completed through our website, the accommodation will be blocked for the requesting client for next day. During this period, the client must confirm the reservation by paying by bank transfer or credit card 40% of the total amount. After this time from the request and there is no proof of payment of 40%, the reservation will automatically be canceled and deleted. In the case of reservations with last minute or last minute discounts applied, you will only have 24 hours to confirm the reservation, otherwise it will be automatically canceled.
When making payment, the client/tenant declares at the same time that he or she has read, understood and accepts the general conditions of the agency.
Payments will be made through the payment gateway with a debit or credit card or by bank transfer to the bank account provided and which appears in the email you will receive when completing and sending the reservation form.
The transfer concept must include the reservation locator number provided to identify your payment, being able to provide, if possible, the DNI or passport number of the person who appears on the same reservation form to be able to identify which reservation it corresponds to. the pay.
The payment method will be made as follows:
1st payment: 40% of the total amount to confirm the reservation by transfer or bank card via ON-LINE payment gateway.
2nd payment: 60% upon signing the contract and handing over the keys, along with the cash deposit.
After 24 hours from 5:00 p.m. on the day of entry (Check in) and if the request to cancel the reservation has not been made or notified by reliable means, the property may be reserved by a new person. client without any right to a refund of the amount paid as a reservation.
Special requests
Requests and requests will be taken into consideration, but in no case is their granting guaranteed.
Bail
A deposit is required, the amount of which appears in the characteristics of the descriptive sheet of each home, expressed in euros, which is used as a guarantee of good use, conservation of furniture, fixtures and conditions of use of the contracted accommodation. This amount will be effective upon signing the contract, in cash, receiving a receipt for its delivery.
After the agreed time, clients must vacate the accommodation. In case of non-compliance, the company has the right to receive as compensation the daily amount equivalent to twice the amount of the daily price of the reservation amount, which will be automatically paid from the amount deposited as a deposit.
To facilitate your departure on the day of departure, the deposit will be returned by bank transfer at no cost, after inspecting the home, allowing you to check out directly without waiting for the home to be inspected. In the event that the tenant or any of his companions has caused any damage to the home or belongings, the economic cost of its repair or replacement will be deducted from the deposit. If the financial amount exceeds the amount of the deposit, it must be paid before the tenant leaves, adopting the necessary legal measures to collect otherwise.
According to the Law, the return of the deposit will not exceed one month from leaving the house.
Schedules
Entry to the properties occurs from 5:00 p.m. Their departure is at 11:00 in the morning.
Maximum number of occupants
Occupation of the accommodation by a number of people greater than that established in the reservation will cause immediate expulsion without the right to a refund of the reservation amount.
Reserve modification
Although the descriptions, details of the accommodation equipment and the prices published on the website, www.tucasaenchiclana.com, have been carefully prepared, they may in some cases undergo some modification that will be communicated at the time of making the reservation. It could be the case that these modifications occur after confirmation of the reservation and that they affect essential points of the contract. In this case, you may terminate the contract, free of charge, within 7 days following said communication, with the payment made being refunded in full as long as said change is within a minimum period of 30 days from the date of entry.
Cancelation conditions
You can cancel your reservation at any time, although if it occurs less than three days from the arrival date, 25% of the total amount will be charged as cancellation fees. To cancel, please contact vacations@tucasaenchiclana.com indicating your reservation number.
Reservation cancellation
After receiving 40% of your Reservation, the client will be notified by email of the Confirmation of your Reservation, and in the event of unilateral withdrawal by the client from using the contracted home, the amount contributed will NOT be refunded except who has taken the Cancellation Insurance.
To recover the amount paid as Confirmation, the Cancellation Insurance must have been previously taken within the deadline, and provided that the cause of cancellation appears among the probable causes in the General Conditions of the Insurance subscribed and which appear in the following link in the General conditions.
If after 48 hours of the day / time stipulated for entry to the accommodation, the CLIENT has not made an appearance or notified in a reliable manner of his delay, the reservation will be understood as CANCELED, and the accommodation may be made available again without the right to a refund. some to the CUSTOMER.
Cancellation insurance
The cancellation insurance is contracted with the insurance company ERGO.
The amount will be €30 (Thirty euros).

General conditions
To contract cancellation insurance, it must be requested in the RESERVATION DATA form or, failing that, send it to us within the first 48 hours of sending the Reservation form.
The intermediary agency between the Insurance Company and the client for contracting said insurance, and in no case participates directly or indirectly in possible accidents or cases in which it must be used. All documentation that is requested for the resolution of a claim will be carried out by the client with the insurance company.
In the event that the client leaves the accommodation voluntarily, for any reason or circumstance before the end of the contract, and the CANCELLATION INSURANCE has not been subscribed, the agency is exempt from any type of refund for this concept.
Alternative or cancellation of the contract
In cases of force majeure or unforeseen impossibility of the property for the client's accommodation, the agency will offer the client the possibility of choosing (when possible) between replacing the accommodation with another one with similar characteristics and price, or canceling the contract by refunding the client. the total amount delivered. The agency reserves the right to replace the reserved accommodation with another with similar characteristics in the event of a serious unexpected event. In the case of force majeure, the agency may cancel the contract by refunding the total amount delivered.
Attributable responsibilities
If the reserved accommodation presents serious deficiencies that prevent its normal use, the agency undertakes to find an alternative solution with similar characteristics and price. If this is not feasible due to a lack of available accommodation or because you reject all the proposals offered, all or part of the reservation amount will be refunded - depending on the time you have enjoyed the accommodation -, without the agency being liable. any additional.
The agency will also not assume any responsibility in the following cases:
1. Negligence or omission of services attributable to third parties.
2. Failures or incorrect operation of swimming pools, children's play areas and sports facilities of any type, the use of these being strictly under the responsibility of the user.
3. Thefts in accommodation or common areas.
4. Damage to people or things caused by causes of force majeure or unforeseen setbacks for which neither the agency nor its representatives (key managers) can be held responsible due to causes of force majeure, natural or meteorological disasters beyond the agency's control.
5. Loss or misplacement of key(s) to the home. In this case, the agency will proceed for the safety of the home and its occupants to replace the lock of the home if possible, and the client must pay the amount that such replacement entails. In the event that the lock is forgotten inside the home and it is necessary to open it by a locksmith or similar and/or replace the lock, the client will also assume these costs.
In the event that events occur that could disrupt the client's stay such as: power cuts, water cuts or noise due to construction in the surroundings of the contracted accommodation, the agency does not assume any responsibility given that these are situations beyond its control. .
The responsibility of the agency, therefore, is limited to its intermediation function, in accordance with the scope it has and is effectively developed by the agency, not personally assuming any of the responsibilities that, according to Law, correspond to the property in the rental of seasonal accommodation.
In any case, the Client accepts that the financial responsibility of the agency for possible moral damages that may be caused as a result of its intermediation, will be limited to the total amount paid for rental.
About the delivery and return of the home
The effective occupancy of the accommodation will occur on the day of arrival starting at 5 p.m. During the first 24 hours, from the occupancy of the home, the client must notify the agency of any damage, defect or malfunction observed in the home so that the company can proceed with the repair that corresponds to the property. as soon as possible, after these first 24 hours and if no notification has been received from the client, the agency will understand that the home is in perfect condition.
Key collection: It will take place at the agency's offices or at the entrance of the home if this has been agreed between both parties, setting a specific time in advance. On the website, in the "Contact" section, there is information on how to get to our office, to facilitate your arrival.
Previously, you will have been sent by email information on the status of your reservation, amount paid and pending, location information and a LINK TO PROVIDE TRAVELERS' DATA (CHECK IN ONLINE).
Therefore, if you do not send us the data by this means, you may have to wait until you have attended to those who have done so correctly.
In the event that the client cannot arrive during office hours, they will contact the agency to arrange the delivery of keys, otherwise the company cannot be held responsible for any consequences that may arise from this fact. Handover of keys after 8:00 p.m. will result in the payment of an additional fee.
Departure from the accommodation: The client must contact the agency 2 days before the end of the stay to specify the approximate departure time, which must be between 10 and 11 a.m. in the morning, so that Company staff review the state of the home with the tenant and proceed to return the deposit and return the keys. Once the deposit is returned, you will not be able to use the home. If you choose to receive the refund of the deposit by transfer, you will be provided with information on how to process the return of the keys. Clients who wish to leave before the specified time must notify the agency to review the deposit, which will be returned by bank transfer within a maximum period of 48 hours after their departure, once the perfect condition of the home has been verified.
The client must leave the accommodation, in the same state in which it was found, tidy and without accumulated garbage, otherwise part of the deposit may be used or, in serious cases, the loss of the deposit in its entirety.
About the conditions of use, occupation of the home and its services
The client will provide the agency with the necessary data that current legislation requires for the control of travelers, according to Organic Law 1/1992, of February 21, and must provide the documentation of each person over 16 years of age who occupies the home. throughout the stay. The number of people authorized in the reservation will be respected and in the event that the accommodation is occupied by a number of people greater than the permitted capacity, the company reserves the right to cancel the rental contract immediately as well as to take action. relevant judicial proceedings. Children over two years of age occupy an adult seat. Extra beds or other similar furniture not included in the inventory are prohibited unless expressly authorized by the company.
In the event that any appliance stops working or any breakdown is noted in the water, electricity, gas or other services installations, the client must notify the agency so that it can in turn notify the corresponding authorized technical service to repair it. the breakdown as soon as possible. The agency is not responsible for local or general power outages in the area.
In the case of gas supply through independent cylinders or bottles, the client must notify the company of the termination of the gas supply, so that the company can replace the service as soon as possible. The immediate supply of said bottles or cylinders cannot be guaranteed, so it will be the client's responsibility to provide them with a full tank bottle or cylinder in advance.
The client is expressly prohibited from modifying the initial configuration of the furniture in the home. If this rule is not followed, the company reserves the right to retain part or all of the deposit deposited.
The client is expressly prohibited from carrying out any activity that conflicts with municipal regulations and with the usual practices of coexistence, hygiene and public order or that prevent the normal rest of other users of the property or urbanization. It is prohibited to make noise in the rented home or its surroundings after 24 hours.
The client is expressly prohibited from accumulating garbage both inside and outside the contracted accommodation, and must deposit it using standard bags in the container closest to the home and at the time indicated by the municipal service. Otherwise, the company reserves the right to retain a part of the deposit for this reason.
Pets or animals
When checking availability in the system or by phone, you are obliged to indicate that you wish to use the home with pets or domestic animals, stating in the description of each home whether or not the stay of animals is allowed.
Pets are not authorized unless expressly authorized by the company. If the contrary is proven, the agency reserves the right to cancel the rental contract immediately as well as to take the relevant legal actions in addition to retaining the guarantee or deposit in the event that the animal has caused damage to the home, dirt or any other type of damage.
Pets are at all times under the responsibility of their owner, or failing that, of the person who signs the rental contract and whose housed pets must be up to date on their mandatory periodic vaccinations, as well as must be provided with identification by chip or any other requirement of current regulations and which may be required to be presented both on the day of arrival and during the stay.
Although each urbanization or residential area has specific Rules of the Community of Owners, we recommend that every time you walk with your pet through the common areas you should do so using a short leash to guarantee control over the pet at all times.
Validity and competent jurisdiction
When making an accommodation reservation, the general conditions indicated above will come into force and will govern the existing seasonal accommodation rental contract between the client and the Property. The agency acts as an intermediary between the tenant and the owner of the accommodation and is responsible for the correct execution of the mediation, which is carried out in accordance with current laws.
These general conditions together with the indicated prices are considered valid, except for typographical errors, from 10/01/2015 to 12/31/2016 and replace the previous published conditions.
These general conditions and the contract between the client and the Property will be governed, interpreted and executed according to Spanish law, subject to the courts of Chiclana de la Frontera (Cádiz), Spain.
